Check/verify the terms of service.

The email service used is irrelevant to the ISP's complaint. What is
important is not the email service used by the user, but rather the
user's email/online behaviour itself. Moreover it is idiotic to respond
to a complaint about one user's behaviour by applying a blanket
punishment to the rest of that email service's compliant users.

Brillant, except that webmail is a growing, not a shrinking, trend :p
