As a member of the ALA Intellectual Freedom Committee at the time the first
interpretation of the Library Bill of Rights on confidentiality was
developed, I suggest that librarians in privately-funded institutions check
with their institution's attorney to determine whether or how
confidentiality laws affect them.
I would be willing to bet that academic institutions have reviewed their
policies in light of laws requiring confidentiality of ALL records, not just
library circulation records.. For example, when I attended UC Berkeley
shortly after the earth cooled <g> there was a card file, accessible to
anyone who wanted to look in it, which listed the names and addresses of
students. I believe the university eliminated that file after members of
the Symbionese Liberation Army located and abducted Patricia Hearst.
